Types of Enforcement:

Scotland – Types of Diligence

In Scotland, we enforce non-paid court decrees through a range of legal recovery methods known as diligence. These include:

  • Charge for Payment – A formal demand giving the debtor 14 days to pay the debt before further enforcement.

  • Earnings Arrestment – Deductions made directly from a debtor's wages.

  • Bank Arrestment – Freezing and recovering funds from the debtor’s bank account.

  • Attachment and Exceptional Attachment – Seizing non-essential assets held outside the home or, with court approval, within the home.

  • Inhibition – Preventing the sale or transfer of property owned by the debtor.

  • Money Attachment – Seizing cash or cheques held on the debtor’s premises.

We work with authorised Sheriff Officers to ensure these methods are applied effectively and lawfully.
